Three 17-year-old boys have been arrested for allegedly allowing a friend to drive drunk.
Police said the boys knew Modlesky was drunk when she got behind the wheel. Two boys are charged with reckless endangerment and the third boy is charged with violation of passenger restrictions and operating a motor vehicle between 11 p.m. and 5 a.m.
“There is a moral ambiguity and a legal ambiguity in this country,” Fox News Legal Analyst Peter Johnson Jr. said. He compared it to the Erin Cox case in North Andover, Mass. “She got into trouble because she went to the aide of another student who happened to be drunk and went to pick her up at a party. She was then suspended from the [volleyball] team and faced all kinds of sanctions from the school. So we have to figure out one way or the other, we have to send the message out to children and teens in America that you might get into trouble for not helping out.”
The teenage boys charged in Modlesky's case are due in court later this month.
